Welcome to ProShotsAI, operated by UpVision GmbH, Haldenstrasse 13, 2503 Biel, Switzerland. These Terms of Service govern your use of our website, products, and services. By accessing or using ProShotsAI, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

• Service — The ProShotsAI website and platform that enables users to create AI-generated professional headshots and lifestyle photos.
• User — Any individual who accesses or uses the Service.
• Content — All photos, images, and other files you upload to the Service.
• Generated Images — AI-generated images created by the Service based on your Content.

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information and to keep it up to date.

You are responsible for safeguarding your account password and for all activity that occurs under your account. Notify us immediately at support@proshotsai.com if you suspect unauthorized access.

ProShotsAI offers one-time purchase packages. By placing an order, you agree to pay the stated price for that package. All prices are shown inclusive of any applicable taxes unless otherwise stated.

Payments are processed securely by Stripe. ProShotsAI does not store your full payment card details. Your purchase grants you access to the credits and features described at the time of purchase.

There are no recurring subscriptions unless explicitly offered and selected by you.

You retain full ownership of the original photos you upload to the Service. By uploading Content, you grant ProShotsAI a limited license to process and use your photos solely for the purpose of generating your AI images.

You own the Generated Images created from your Content. ProShotsAI grants you a non-exclusive, worldwide, perpetual license to use, reproduce, and distribute the Generated Images for personal and commercial purposes.

ProShotsAI may use anonymized, aggregated data derived from usage patterns to improve our AI models and service quality. We will not use your personal photos for any purpose other than generating your images.

You agree not to use the Service to:

• Upload Content that infringes intellectual property rights, privacy rights, or other rights of third parties
• Create, upload, or share Content that is illegal, harmful, threatening, defamatory, or otherwise objectionable
• Impersonate any person or entity or provide false information
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to the Service or its related systems
• Upload images of minors for AI training purposes
• Use the Service to create deceptive or misleading content about real individuals without their consent

AI-generated images are created algorithmically. While we strive for high quality and accuracy, results may vary. ProShotsAI makes no guarantees about the outcome of any specific generation. You are responsible for reviewing and selecting which images you use.

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service ceases, though previously downloaded Generated Images remain yours.

To the fullest extent permitted by applicable law, ProShotsAI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

These Terms are governed by and construed in accordance with the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Biel/Bienne, Switzerland.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
